Welcome to Aqualithe. These Terms and Conditions (“Terms”) govern your access to and use of the Aqualithe website, and your purchase of water filtration products, consultations, water assessments, and installation services from Aqualithe (“we”, “us”, “our”, “the Company”).
Please read these Terms carefully before using our website or engaging our services. By accessing our website, requesting a consultation, placing an order, or using any Aqualithe service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our website or services.
For the purposes of these Terms:
These Terms set out the rights and obligations of all visitors, users, and customers regarding the use of our website and the supply of our Products and Services. By accessing or using our website, or by placing an Order, you agree to be bound by these Terms.
Your use of our website is also subject to our Privacy Policy, which explains how we collect, use, and protect your personal information. We recommend reading it alongside these Terms.
You represent that you are at least 18 years of age. Aqualithe does not knowingly supply Products or Services to, or collect information from, individuals under 18.
Nothing in these Terms limits or excludes any right you have under the Australian Consumer Law that cannot lawfully be excluded, restricted, or modified.
Aqualithe supplies and installs whole-home water filtration systems, reverse osmosis systems, rainwater filtration systems, and related products for residential properties across Australia. Our services may include:
Product descriptions, images, and specifications on our website are provided for general guidance. While we make reasonable efforts to keep this information accurate and current, actual system performance can vary depending on your local water source, plumbing, household usage, and other site-specific conditions. A formal water assessment is recommended before purchase to confirm the right solution for your property.
4.1 Quotes. Any quote provided by Aqualithe, whether verbal, written, or generated through our website, is valid for the period stated in the quote or, if no period is stated, for 30 days from the date of issue. Quotes are based on the information available to us at the time and may be revised if site conditions, water assessment results, or scope of work change.
4.2 Orders. Submitting an enquiry or Order through our website, by phone, or during a consultation does not guarantee acceptance. We will confirm acceptance of your Order in writing (including by email) before it becomes binding.
4.3 Pricing. All prices are listed in Australian Dollars (AUD) and, unless stated otherwise, include GST. We reserve the right to correct pricing errors on our website or in a quote and will notify you before proceeding if a correction affects your Order.
4.4 Payment. Payment terms (including any deposit, progress payment, or balance due on completion) will be set out in your quote or invoice. Full payment or an agreed deposit may be required before we schedule installation. We accept payment methods as advised at the time of your Order.
4.5 Ownership. Ownership of Products passes to you once payment has been received in full. Until that time, Aqualithe retains ownership of any Products supplied, notwithstanding delivery or installation.
5.1 Scheduling. Installation appointments are scheduled based on availability and will be confirmed with you in advance. While we make every reasonable effort to meet agreed dates, timeframes may be affected by factors outside our control, including site access, supply delays, or unforeseen plumbing conditions.
5.2 Site Access and Preparation. You are responsible for ensuring our installation team has safe and reasonable access to the property and relevant plumbing on the scheduled date. Additional costs may apply if access issues, non-standard plumbing configurations, or site conditions not identified during the initial assessment require extra work.
5.3 Existing Plumbing and Structures. Aqualithe is not responsible for pre-existing plumbing, electrical, or structural issues at your property that are identified during or after installation, though we will always advise you if we become aware of a concern.
6.1 Consumer Guarantees. Our Products and Services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure, and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have Products repaired or replaced if the Products fail to be of acceptable quality and the failure does not amount to a major failure.
6.2 Manufacturer and Aqualithe Warranties. Specific Products may be supplied with a manufacturer’s warranty or an Aqualithe workmanship warranty, the terms of which will be provided to you at the time of purchase or installation. Nothing in any such warranty limits your rights under the Australian Consumer Law.
6.3 Warranty Exclusions. Warranties do not cover damage caused by misuse, neglect, failure to perform recommended servicing or filter replacement, unauthorised repairs or modifications, or normal wear and tear of consumable parts such as filter cartridges and membranes.
6.4 Making a Warranty Claim. If you believe a Product is faulty or a Service has not been performed with due care and skill, please contact us using the details in Section 15 so we can arrange an assessment.
7.1 Cooling-Off Period. Where required by law, you may have a right to cancel certain Orders within a cooling-off period. Details of any applicable cooling-off period will be provided at the time of your Order.
7.2 Change of Mind. Outside of any statutory cooling-off period, change-of-mind returns are considered at Aqualithe’s discretion and may be subject to a restocking fee, provided the Product is unused, unopened, and in its original condition. Custom-configured systems and Products that have been installed are generally not eligible for change-of-mind returns.
7.3 Cancelling Installation Bookings. If you need to cancel or reschedule a confirmed installation appointment, please contact us with as much notice as possible. Cancellations made with insufficient notice may incur a call-out or rescheduling fee, which will be advised to you in advance.
7.4 Faulty Products. Your rights in relation to faulty Products are set out in Section 6 (Product Warranties and Australian Consumer Law) and are not affected by this section.
Water filtration systems require periodic servicing and filter or membrane replacement to perform as intended. Where you have an ongoing servicing arrangement with Aqualithe, its terms (including frequency and cost) will be set out separately. Failure to maintain your system in line with our recommendations may affect performance and could void applicable warranties.
